### CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

**GENERAL:**

When you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

Shipping costs for the product shipment will be paid by the buyers.

Each purchased product is delivered to the person and/or organization at the address indicated by the buyer within 30 days, not exceeding the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

The purchased product must be delivered complete and in accordance with the specifications specified in the order and, if any, with documents such as a warranty certificate and user manual.

In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from learning of it. The total amount must be returned to the buyer within 14 days.

**IF THE PURCHASED PRODUCT IS NOT PAID FOR:**

If the buyer does not pay for the purchased product or cancels it in the bank records, the seller’s obligation to deliver the product ends.

**PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:**

After the product is delivered, if it is determined that the credit card used for payment was unfairly used by unauthorized persons and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.

**IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:**

If there are unforeseen circumstances that the seller could not have foreseen and the product cannot be delivered on time, the situation will be notified to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if the payment was made in cash, the payment will be refunded in cash within 14 days from the cancellation. If the buyer made the payment by credit card and cancels it, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the buyer’s account.

**THE BUYER’S OBLIGATION TO INSPECT THE PRODUCT:**

The buyer will inspect the goods/services subject to the contract before receiving them; and will not accept the damaged and defective goods/services such as crushed, broken, torn packaging, etc. from the cargo company. The goods/services received will be deemed undamaged and intact. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must also be returned with the product.

**RIGHT OF WITHDRAWAL:**

The BUYER can exercise the right to withdraw from the contract by rejecting the goods without any legal or penal liability and without giving any reason, within 14 (fourteen) days from the date of delivery of the purchased product to the BUYER or the person/organization at the indicated address, by notifying the SELLER through the contact information below.

**WITHDRAWAL PERIOD:**

If the purchased item is a service, this 14-day period starts from the date of signing the contract. The right of withdrawal cannot be used for service contracts that have begun to be performed with the consumer’s approval before the withdrawal period expires.

The costs arising from the use of the right of withdrawal belong to the SELLER.

In order to exercise the right of withdrawal, written notification must be sent to the SELLER within 14 (fourteen) days by registered mail, fax, or email, and the product must not be used within the framework of the “Products for which the Right of Withdrawal Cannot Be Used” provisions stipulated in this contract.

**USE OF THE RIGHT OF WITHDRAWAL:**

The invoice of the product delivered to the 3rd party or the BUYER, (If the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Returns of orders issued to corporate entities cannot be completed unless a RETURN INVOICE is issued.)

Return form, the products to be returned must be delivered complete and undamaged, together with the box, packaging, and standard accessories, if any.

**RETURN CONDITIONS:**

The SELLER is obliged to return the total amount and any documents that put the BUYER under debt to the BUYER within 10 days from the receipt of the withdrawal notification, and to accept the return of the goods within 20 days.

If there is a decrease in the value of the goods due to the fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the damages of the SELLER at the rate of the BUYER’s fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or products within the right of withdrawal period.

If the value of the campaign used within the scope of the campaign organized by the SELLER falls below the limit amount due to the use of the right of withdrawal, the discount amount used within the campaign will be canceled.

**PRODUCTS THAT CANNOT BE USED WITH THE RIGHT OF WITHDRAWAL:**

Products prepared in line with the BUYER’s request or clearly in accordance with his personal needs and which are not suitable for return, bottom parts of underwear, swimwear and bikini bottoms, make-up materials, disposable products, goods that are in danger of spoiling quickly or are likely to expire, goods that are not suitable for return in terms of health and hygiene if the packaging is opened by the BUYER after delivery, goods that are mixed with other products after delivery and cannot be separated by their nature, except for those provided under the subscription agreement, periodicals such as newspapers and magazines, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if the packaging has been opened by the BUYER, cannot be returned as per the Regulation. In addition, it is not possible to exercise the right of withdrawal for services that have begun to be performed with the approval of the consumer before the expiry of the right of withdrawal period as per the Regulation.

Cosmetics and personal care products, underwear products, swimwear, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs, and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untested, undamaged, and unused in order to be returned.

**DEFAULT AND LEGAL CONSEQUENCES**

The BUYER agrees, declares, and undertakes that if the BUYER defaults on the payment transactions made with a credit card, the cardholder will pay interest within the framework of the credit card agreement with the bank and be liable to the bank. In this case, the relevant bank may take legal action; and may demand the costs and attorney’s fees from the BUYER and, in any case, if the BUYER defaults on the debt, the BUYER agrees to pay the SELLER’s damages and losses due to the delayed performance of the debt.
